Medical Malpractice and Statute of Limitations

The statute of limitations with respect to medical malpractice cases can be complex and difficult to calculate. Not only do the laws differ from state to state, time limitations change according to type of injury and whether the claim involves a governmental entity. There can also be various exceptions according to the age of the plaintiff.

The statute of limitations is defined as, -an enactment in a common law legal system that sets the maximum time after an event that legal proceedings based on that event may be initiated.- In other words, the time period between when the injury or wrongful death happened until the final date when a medical malpractice attorney can file the suit.

Always obtain a legal consultation with a personal injury attorney who specializes in medical malpractice law as soon as you suspect you may have a case. If the statute of limitations expires before your medical malpractice suit is filed, the case can be dismissed. If this happens you will have no recourse or means to sue for current injuries or even for future problems that may result for the remainder of your life.

The period of time during which a medical malpractice suit must be filed usually begins with the date of harm. This becomes day one. However, sometimes the injury does not become apparent for days, weeks, months or even years after it happened. In such situations, the statute of limitations could begin running the day the injury was discovered.

For medical malpractice lawsuits brought against health care providers in California, the statute of limitations is filed within three years after the date of the injury, or -one year after the plaintiff discovers, or should have discovered, the injury, whichever occurs first.-

There are exceptions to this rule, the first regarding claims based on a foreign object left inside the injured person’s body (such as surgical scissors or gauze) In these cases the statute of limitations day one begins when the person discovers, or should have discovered, the foreign object. Another exception addresses cases involving minor children under the age of six. For a minor under six, the case must be filed within three years of the date of injury or before the child’s eighth birthday, whichever is the longer amount of time.

After talking with the scared to death songwriter that he felt in his soul that he had no choice but to create a song during this life hanging in the balance moment.

The other songwriter told him that he’s glad that he made that decision because a song came down to him in a very special dream during the night which was all about never quiting no matter what. And as the guitars began to play and the words began to be sung. The following song and song lyrics were born. Perhaps to inspire those hearing this song and reading these words that no matter what…..It ain’t ever over at halftime.

Manual Therapy For The Treatment Of Temporomandibular Disorder New Research

You notice some pain in your jaw when chewing, which progressively worsens over several weeks. Occasionally you feel a clicking or catching in your jaw when opening and closing your mouth. Eventually you are unable to fully open your mouth and experience pain even when you speak. If you have never experienced this, count yourself very lucky. If you have, you are already familiar with the relatively common condition known as TMD.

TMD, short for temperomandibular disorder, is estimated to affect as much as 40% of the population at some point in their lifetimes, and is especially prevalent in the young. Initial diagnosis is typically made through a visit to the dentist, and the eventual treatment multidisciplinary with various management techniques. One of the lesser known treatment techniques, but something that is gaining in popularity, is soft-tissue therapy of the masticatory muscles the muscles used to move the jaw.

As a sports chiropractor using manual soft-tissue therapy on a daily basis, I have treated TMD on many occasions with success, however good research on the subject has been lacking. Recently however, this type of myofascial therapy for TMD was tested for efficacy in a randomized, controlled clinical trial. Researchers from Macquarie University in Sydney, Australia examined the clinical effectiveness of manual therapy in the treatment TMD. Specifically, they compared myofascial therapy to myofascial therapy plus self-care and education and no care (the control group in the study).

This was a private clinic-based study, with eligible participants ranging from age 18-50 presenting with jaw pain with or without joint sounds of at least 3 months and a willingness to participate in the study. Patients with physical or psychological contraindications were excluded. The outcome measures were jaw pain at rest, jaw pain upon maximal active opening, and jaw pain upon clenching.

The primary therapy consisted of myofascial release of the masticatory muscles, including the temporalis, medial and lateral pterygoid, and masseter. The subjects were treated twice per week over a period of 6 weeks for a total of 12 therapy sessions. Additionally, one group was given additional education and self-care consisting of self-mobilization, exercises and stretching, as well as general education on TML anatomy, biomechanics, disc displacement and dysfunction, and the role of psychoemotional factors contributing to TMD.

The results showed a statistically significant positive efficacy for both the myofascial therapy only, and the myofascial therapy plus education and self-care groups. Not surprisingly, the therapy plus self-care group showed a better 1 year outcome than the therapy alone group a trend that has been supported for the care of most musculoskeletal conditions.

Although the results of this study are no surprise to those practicing manual therapy, it serves to reinforce what we already know anecdotally. For patients suffering from TMD there is now evidence for another great intervention, and for manual therapists not currently treating TMD, there is a great opportunity to expand your skillset and serve those in need.

Ahmad Khawaja, the Rock Star Artist

Ahmad Khawaja, the lead singer of the band, The Outcasts, started singing at an early age. He came from a family of singers and ever since, he was always in a certain band singing the lead. Also, he is quite talented with an electric guitar and drums which always got him grounded for disturbing his neighbors back in New Orleans.

Ahmad Khawaja was the youngest of 3 children, enough reason for him to be doted upon by his mother. By the time he was in middle school, he expressed his wishes to join in a rock band. This, of course, was frowned upon by his father who was a highly conservative and religious person. Although also a musician, his father’s genre of music was into the classical and religious scenes. When he was in junior high, he and his high school band, The Boarders, started playing on their school gigs. They later started playing on the local shows in town during special events.

The Boarders, however, soon disbanded for different reasons. Two members of the band, Ahmad and his best friend Michael Pensworth decided to pursue their career as rock star artists. After meeting the other members of the group in a local bar, The Outcasts was formed.

At the start of the band formation, everything was not really smooth with them that the group almost disbanded. It was Ahmad who made the group promise that they were not to disband without even trying for one last gig. It was at this gig that they started to be noticed and soon afterwards, the rest was just history. Producers soon came knocking on their doorsteps with various offers of supporting them as well as endorsements. The Outcasts write their own songs and compose their own music with messages regarding love and nationalism. The Outcasts are actually the youth’s idol when it comes to the rock star band of the 21st century without the drugs and the booze.

Ahmad Khawaja and The Outcasts have come a long way since. Occupational Therapy to Improve Improper Pencil Grip in Children

There are a number of developmental, cognitive and intellectual aberrations that may present with difficulties in learning capabilities and school performance. Healthcare providers suggest early identification and appropriate management or training can lead to absolutely normal or near normal development in children that does not interfere with personal, social and occupational aspects of life in adulthood.

Improper pencil grip is the leading cause of poor handwriting as a result of impaired motor skills. It has been observed that development of pencil grip and good hand-writing is an automatic reflex that develops during the early years of schooling; however, in some children this reflex is significantly impaired. There are a number of parameters that are used by educators and teachers to determine the hand-writing and pencil grip in school- aged children as young as 9 to 10 years. The parameters like use of appropriate spacing between letters and words, accuracy of letter formation, legibility, letter size uniformity, letter slant, and alignment of words on the sheet are used as important tool in the assessment of improper pencil grip in children.

Research conducted by Carter and Synolds suggested that the majority of the children with handwriting abnormalities develop symptoms of learning disabilities in coming years.

Colleen M. Schneck conducted a research study on 60 school-aged children to assess the handwriting skills in accordance with the pencil grip and identified that the children who presented with poor handwriting also performed poorly at pencil gripping test (drawing tasks) and also manifested symptoms of impaired proprioceptive-kinesthetic awareness (impaired hand preference and perception of pencil and paper and distance of pencil from paper).

Research conducted by Benbow suggests that the position of head and distance of the writing surface from eyes plays a very important role in the development of improper grip. He explained that if the actual cause is not identified at an early age, the chances are high that the developmental disabilities or learning deficits may go unnoticed or misdiagnosed, affecting the entire life of the child. Benbow coined the term somesthetic feedback that is a form of visual compensation as the distance between the eyes and writing surface is very little, leading to fatigued visual input.

Research conducted by Laszlo and Bairstow suggested that children are unable to master their writing skills and proprioceptive-kinesthetic ability (the response of joints to the movements performed by fingers) until at least 6 years of age; but various simple tasks can help in early determination of impaired writing skills. For example an inability to color within boundaries or the inability to build blocks suggests a sluggish proprioceptive-kinesthetic capacity.

Laszlo suggests that assessment of such children in second standard is very helpful in reaching to a diagnosis to establish if the child needs therapy or mere lifestyle modification is enough. Occupational therapy is helpful in all such children as the trained therapists can identify and diagnose improper pencil grip reflex earlier than the healthcare providers and advise therapies for treatment.
